If you pay the additional fee prescribed by ACER from time to time for the making of additional hard copy reproductions of copyright material included in the Service, you may make additional hardcopy reproductions of that material. 4. Copyright in the bibliographic data in the Service remains the property of ACER. 5. Copyright in the text of any copyright material included in the Service remains the property of the original publisher or other rightsholder. 6. Information on your use of the Service may be collected and passed to Copyright Agency Limited (CAL) for the following purposes: (a) to allocate monies to CAL members for the use of their copyright material; (b) to determine whether you require or have in force a relevant licence from CAL; and (c) the negotiation of a relevant licence. CAL's Privacy Policy may be inspected at www.copyright.com.au. 7. ACER does not warrant that the Service will meet your requirements, that its operation will be uninterrupted or error free or that the source data or methodology is accurate. This Agreement shall be construed in accordance with the laws of the State of New South Wales and within the jurisdiction of the courts of that state. Should any part of this Agreement be or become invalid, that part at the option of ACER shall be severed from this Agreement without affecting the validity of the remaining provisions. No delay or indulgence by ACER in enforcing this contract shall prejudice its rights. 10. Use of the Service indicates acceptance of the terms and conditions of this Agreement by you and your willingness to be bound by these terms.
